CIRCULAR NO. 10/98-GUIDELINES ON DONATIONS OR REAL PROPERTY

TO ALL PARISH PRIESTS

Dear Msgr./Rev. Fr.

Peace!

In the First Provincial Council of Cebu, Decree no. 345, it is provided that “The  building and the site of a church, chapel, or oratory should be permanently under ecclesiastical authority”. With this as our consideration, it is the common policy, unless serious pastoral reasons warrant otherwise, to prohibit the celebration of the sacraments in chapels or oratories which have not been submitted to ecclesiastical authority, or which are private properties of individuals or societies not under ecclesiastical authority.”

In order to realize this provision and for your guidance, we issue the guidelines in transactions involving donations of real property in favor of the Roman Catholic Archbishop of Cebu.

Attached herewith are the guidelines and the samples of the deed of donation and the deed of usufruct.

We request you to give due attention on this concern.
